1 All bookings accepted by us are subject to these
terms and conditions.
2.
Booking procedure and payment terms
2.1 Clients should complete
the booking form and forward it with a deposit of £100 per week
payable to: F & B Walsh.
2.2 Any provisional booking
will be held for seven days (7) pending receipt of the signed
booking form and deposit of £100 in respect of each week's accommodation.
A booking will be considered firm when the deposit has been received
and we have confirmed the booking in writing to the client.
2.3 The balance is due
8 weeks before the date you arrive at the home. No reminder will
be issued. Bookings made within 8 weeks of departure are payable
in full at the time of booking. Including security deposit.
2.4 You may change your booking.
In which case we will make every effort to accommodate any requests.
There is a £25 administration fee per week for this service.
2.5 A cheque
for £200 is required as security against damage whilst you are
in the Home. The security payment should accompany your final
payment and will be returned to you within 4 weeks of your departure
from the villa subject to there being no damage. Alternatively you can pay our managing agents a non-refundable
insurance payment or provide them with a credit card swipe upon
arrival.
2.6 Minimum booking period of
stay is seven days, (7) unless special arrangements have been
made at the time of booking.
3. Cancellation
3.1 You may cancel the holiday
booked at any time after it has been confirmed subject to clause
3.3 below. Cancellation must be in writing.
3.2 We reserve the right to cancel
the holiday if payment has not been received in accordance with
clause 2.3 above.
3.3 The following cancellation
charges will apply to all rentals cancelled in accordance with
clauses 3.1 and 3.2 above. More than 60 days prior to departure
- loss of rental deposit,30 to 60 days - 50% of total rental,
Within 30 days - 100% of total rental. The security deposit is
not subject to cancellation charges and would be refunded in full.
All cancellations are subject to a £25.00 administrative fee.
3.4 Alterations By You: If once
the booking has been accepted you wish to make any alterations
to the booking details, we will do all we can to assist provided
that the request is made in writing by the person who signed the
booking form. Some alterations may incur an administrative fee
of £25 per person affected by the change. Material alterations
may be treated as a cancellation. Any alterations made by you
less than 9 weeks before the date of arrival at the villa may
be treated by us as a cancellation and so subject to the cancellation
charges.
3.5 Cancellation By Us- In the
event of cancellation by us we will inform you as soon as reasonably
possible and fully refund you of any money you have paid.
4. Accommodation
4.1
The accommodation provided is only for the use of persons named
by the client on the booking form; subletting, sharing or assigning
are prohibited.
4.2 The property will
be available to clients after 4 pm Florida time on the day of
arrival unless otherwise agreed. All accommodation must be vacated
by 10 am Florida time on the day of departure unless otherwise
agreed.
4.3 An adult must
accompany persons under the age of 18. 4.2 The property will be

4.4 We will not be liable for any loss or injury
resulting from the use of the property and pool.
4.5 Swimming pools are dangerous and ours is not
to be used by children without adult supervision.
4.6 Normal usage of gas,
water and electricity is included in your holiday price. However
the supply of a gas bottle for the Gas BBQ is not included so
must be purchased but the renter. The reasonable cost of cleaning
the property on your departure is also included. Guests are responsible
for leaving the accommodation and its contents clean and in good
order. The lead renter will indemnify us against all loss and
damage caused to the property, including fixtures and fittings,
furniture and swimming pool including any loss of rental income
whilst repairs are being effected to remedy any damage.
4.7 Insects and pests are
inevitably present in the Florida climate. Within reason this
is normal, and we cannot take action to eradicate it. The accommodation
receives periodic pest control treatment. Only when, in our reasonable
opinion, pests in the living accommodation are a serious nuisance
will further action be taken.
5.
Complaints
5.1 In the unlikely
event that the client has any reason for complaint or dissatisfaction,
they must contact the local Management Company caring for the
property in Florida. immediately so that remedial action may be
taken.
6. Passports and travel documents
6.1 Passports and Visas are your personal responsibility. We make no representations and provide no advice, orally,
in writing or otherwise in relation to your passport or visa requirements
to enter into and remain in the USA. You should confirm requirements
with the American Embassy before booking your holiday.
7. Smoking
7.1
For the comfort and safety of clients and guests, Smoking is NOT
permitted in the villa. Smokers may do so in the pool/patio area.
There may be an additional cleaning charge if the client and or
guests choose to ignore this condition of booking
8. Animals and Pets
8.1
Animals and Pets are NOT permitted in the Home.
9. Force Majeure and Liabilty Limitation
9.1
Force Majeure - We accept no responsibility for and shall not
be liable in respect of any loss or damage or alterations, delays
or changes arising from circumstances outside its control such
as war or threat of war, fire or adverse weather conditions, government
action, technical problems with transport, closure or congestion
of airports, cancellations or changes of schedules by airlines,
theft from the premises (both interior and exterior including
garage and pool areas). Please note that in the event that the
weather conditions fall below 50 degrees centigrade the pool heating
will automatically shut off to prevent damage. No refunds will
be given in this event.
9.2
Limitation of Liability. In the unlikely event of us being negligent
and/or in breach of our contract with you our liability shall
be limited to the cost of your booking with us. Further we shall
accept no liability in respect of any loss or damage for which
you are or should be insured or entitled to indemnity from any
third party.
10. Brochure Accuracy
10.1
A great deal of care has been taken to ensure the accuracy
of the information within the Brochure. However, facilities and
services may not be open or available due to renovation/maintenance
works, adverse weather etc. Where we are aware that a facility
or service advertised in the brochure will not be available during
the period of your holiday, we will take steps, wherever possible,
to notify you prior to travel.
11. Travel -
All transportation by air, land or sea is subject to the terms
and conditions of the company providing the transport.
12. Governing Law - The
laws of England and Wales shall apply to this contract and any
other claims.
WE STRONGLY RECOMMEND THAT YOU TAKE OUT
TRAVEL AND MEDICAL HOLIDAY INSURANCE TO COVER UNFORESEEN CIRCUMSTANCES
WHICH MAY NECESSITATE CANCELLATION OF YOUR HOLIDAY. |
